A movie producer with the rights to George Romero's Dawn of the Dead movie sued Dead Rising developer Capcom on Monday after talks between the two parties failed.
As we reported earlier this month, Capcom sought an injunction against the MKR Group to prevent it suing the games company. But it seems it didn't get what it wanted.
"Both works are dark comedies," the complaint filed by MKR reads. "Both works provided thoughtful social commentary on the 'mall culture' zeitgeist, in addition to serving up a sizable portion of sensationalistic violence."
There's more than a healthy link between Dawn of the Dead and Dead Rising, but the crux of the lawsuit appears to be that they both feature zombies in a mall.
Based on that, you could say that the holders of HG Wells estate could sue Roland Emmerich because Independence Day features aliens invading a planet called Earth.
And to say that Dead Rising provided social commentary on anything is just a joke. The only thing razor-sharp in Dead Rising is the chainsaw blades the freaky clown uses to slice you up.
We'll be keeping a close watch on how the lawsuit proceeds. There's a fair bet any possibility of a sequel to a game some of us in the office bought our Xbox 360 for is tied to the outcome.
I seem to remember there being a disclaimer on the front or back of the dead rising box, distancing the game from the Romero films, something along the lines of this game is not endorsed my Romero, in all fairness, you could probably call dead rising a parody of the films, and i dont remember the wachowski brothers kicking off for the endless 'bullet-time' sequences in games, like the article said the game follows the mall/zombie zeitgeist.
This is bound to fail. If the producer wins this case it will open the legal floodgates and allow thousands of cases to be brought to point. The example in the article is a good one and shows the potential for ridiculous lawsuits which could be fueled by the ruling of this case.
Petty and ridiculous, he owns the rights to the film not the idea of zombies in a location. Surely, the rights should really only allow him to produce more ... of the Dead films.
Thats like saying Capcom are being sued because Resident Evil features a house with zombies and was pretty similar to The Evil Dead films.

I have an idea! Sony should sue M$ for making a console, Sega can then sue Sony for copying them, Nintendo can sue Sega then Magnavox can sue everyone cos they originally came up with the idea!!! Get a grip...

Actually my grandfather thought up the idea 75 years ago...he just didn't make one.

It was stated on the front of the packaging that the game was not developed, approved or licensed by the creators but it definitely passes-off as 'Dawn of the Dead'.
